 யுத்தக் குற்றவாளிகளில் ஒருவரென சந்தேகிக்கப்படும் இராணுவ உயர் அதிகாரி ஒருவர் ஐ.நாவுக்கான இலங்கைப் பிரதிநிதியாக நியமிக்கப்பட்டுள்ளார் என்கிற தலைப்பில் நேற்று பத்தி ஒன்றை பிரசுரித்து உள்ளது அமெரிக்காவில் இருந்து வெளிவரும் வொசிங்ரன் ரைம்ஸ் பத்திரிகை.இராணுவத்தின் 58 ஆவது படைப் பிரிவின் கட்டளைத் தளபதியாக அதாவது வன்னிப் பிராந்திய தளபதியாக இருந்த மேஜர் ஜெனரல் சவேந்திர டீ சில்வாவே அந்த இராணுவ உயர் அதிகாரி. இலங்கையின் இறுதி யுத்தத்தில் இடம்பெற்றன என்று கூறப்படும் யுத்தக் குற்றங்கள் சம்பந்தமாக ஐ.நா செயலாளர் நாயகத்துக்கு ஆலோசனை கூறவென நிபுணர் குழு ஒன்று செயற்பட்டு வரும் நிலையில் சவேந்திர டீ சில்வா ஐ.நாவுக்கான இலங்கைப் பிரதிநிதியாக நியமிக்கப்பட்டுள்ளார் என்று அதில் தெரிவிக்கப்பட்டு உள்ளது. இவரது பொறுப்பில் இருந்த படையினர் சரண் அடைய வந்திருந்த தமிழீழ விடுதலைப் புலிகள் இயக்க போராளிகளையும், பொதுமக்களையும் படுகொலை செய்து விட்டனர் என்று சந்தேகிக்கப்படுகின்றது என்றும் இலங்கையின் சண்டே லீடர் பத்திரிகைக்கு முன்னாள் இராணுவ தளபதி சரத் பொன்சேகா வழங்கி இருந்த பேட்டி ஒன்றில் பாதுகாப்பமைச்சுச் செயலாளர் கோட்டாபய ராஜபக்ஸவின் உத்தரவுக்கு அமைய சவேந்திர டீ சிலவா தலைமையிலான படைப் பிரிவினரால் கொல்லப்பட்டனர் என்று கோடிகாட்டி இருந்தார் என்றும் வொசிங்ரன் ரைம்ஸில் கூறப்பட்டுள்ளது. வைத்தியசாலைகள் உட்பட பொது இடங்கள் மீது இவர்கள் எறிகணை வீச்சுக்களை நடத்தினர் என்று குற்றஞ்சாட்டப்பட்டுள்ளது என்றும் குறிப்பிடப்பட்டுள்ளது. ஆனால் இக்குற்றச்சாட்டுக்களை முற்றாக நிராகரித்து உள்ளார் சவேந்திர டீ சில்வா என்றும் இந்நிலையில் சர்வதேச நெருக்கடிகள் குழு ஒன்கிற அரச சார்பற்ற சர்வதேச அமைப்பின் இலங்கை விவகாரங்களுக்கான பணிப்பாளர் Alan Keenan ஐ.நாவுக்கான பிரதிநிதியாக சில்வா நியமிக்கப்பட்டிருக்கின்றமை இலங்கைக்கு எதிராக யுத்தக் குற்ற விசாரணைகளுக்கு ஒரு இடையூறாகவே இருக்கும் என்று கூறி உள்ளார் என்றும் தொடர்கின்றது இப்பத்தி. Here we are not talking about the UN panel or potential ICC /ICJ investigations, because that kind of prosecution will essentially be a state or UN Security Council led procedure. Here we are discussing about this much hyped issue of getting arrest warrants against visiting SLA officers in one of the European or North American courts, based on the Universal Jurisdiction principle. We heard much about the drama surrounding the Maj.General Chagi Gallage affair with contradicting statements from the people involved in this legal matter mainly BTF, GTF and some Tamil lawyers. Gallage Fiasco  In this case, diaspora Tamil organisations did not have any compelling evidence to convince a British judge to issue an arrest warrant, apparently many solicitors and barristers declined to get involved in this case because of lack of proper evidence to prove Gallage’s command-responsibility. Still they pretend that they could have managed to get an arrest warrant against Gallage, had he been in the UK at the time of court proceedings, that’s a BIG LIE. They proceeded with going to court just for the sake of pleasing the diaspora Tamil community. The Common Sense wants to highlight few issues in this matter.
The Common Sense would like to challenge these people by taking the issue of Major General Prasanna De Silva, present Defence Attaché at the Sri Lankan High Commission in the United Kingdom. He has been here for several months. What have they done to arrest him? Someone can say that he holds the diplomatic immunity, the irony is we saw that Preseident Mahinda Rajapakse, the head of state, had to think twice to visit UK, that means the issue of Universal Jurisdiction and the immunity – either diplomatic or sovereign – against a possible prosecution in the UK, is highly fluid and there is no rigid interpretations. So these self-appointed war crimes prosecutors should have at least tried to get an arrest warrant against Prasanna De Silva. That’s where the problem lies, because these organisations have not done any proper work to collect evidence to get an arrest warrant. Otherwise how they are going to explain the fact this person Prasanna De Silva is here in London for several months and they have not done any thing on his matter but making a big noise about an army officer who stayed in the UK for less than a week. Recently Prasanna De Silva inaugurated the Sri Lanka Ex-Service Persons Association, UK at a public event. That shows, he has rightly evaluated the competency of these Tamil organisations and he is not bothered about any potential arrest warrant is being issued against him. The Common Sense’s only request to these organisations is that don’t do things just to please the community and don’t pamper them and lecture them on the matters of genocide and war crimes, while you guys have no idea of what you all are dealing with. Please tell the truth to our naïve people that these things are not easily done. This kind of projects need money and man power that can be achieved only by mass participation at organisation level. That implies diaspora Tamil organisations need to embrace transparency and accountability in their functioning in order to attract public particpation. Please don’t make a joke that, you guys managed to conduct a successful protest campaign against Mahinda during his recent visit to London. The people braved the sub-zero temperature to venture out to demonstrate against Mahinda not because of the competency of these organisations but to express their anger and frustration caused by the inhumane treatment of our brethren in homeland by the Mahinda regime. http://www.anapayan.com/ |
